The collection, storage and sharing of information is an important part of delivering useful banking products and services to our customers. We are concerned about privacy and the use of information a customers gives the Bank. We are committed to protecting our customer’s privacy. As a result, we have established the following privacy principles to provide guidance in our dealings with customers who provide information to the Bank.
- We use, collect and retain information about our customers only for legitimate purposes.
- We obtain public and nonpublic information about customers from many sources including credit reports, loan applications, references and verifications. Our customer provides some information to us; other information is created by us in the course of providing our customers with products and services. Additional information comes from outside sources. We gather, use and keep information about our customers only if we believe:
(a) It is necessary or useful as part of our relationship with the customer;
(b) It will help us provide our customer with products and services meeting their needs; or
(c) Law or regulation requires it.
- Sometimes, as with electronic services (i.e., payroll), we gather, store or analyze data as the agent or service provider for another person, in which case that person decides what data is collected and how it will be used.
- We strive to ensure that our records are up-to-date and accurate in accordance with commercial standards.
- We have procedures in place for maintaining and updating information about our customers. In addition, various state and federal laws impose specific obligations and standards on us with respect to the accuracy of information we maintain, the correction of erroneous information, and disclosure of nonpublic information.
- We have policies and procedures addressing employee access to information about our customers.
- We have procedures in place intended to limit employee access to personally identifiable information about our customers. Employee access to this information is limited to our employees who, because of their position or responsibilities, have a business reason to know or have access to such information. Our employees are bound by applicable privacy laws which address the importance of confidentiality and customer privacy.
- We control the disclosure of account information.
- Within the Bank, we may share information concerning customer account history, experience with us, and other data. We do not reveal specific information about customer accounts, or other personally identifiable data, to affiliates for their independent use unless:
(a) The information is provided to help complete a customer transaction;
(b) You request or authorize it;
(c) The disclosure is made to a financial institution, reputable information reporting agency, merchant or other person in accordance with the law and standard banking industry practice; or
(d) The disclosure is required or allowed by law.
- In addition, sometimes it is necessary for us to disclose confidential customer information to third parties assisting us in the operation of our business, such as vendors and service companies we hire to provide services for us, or to provide support for one of our products or services to our customers.
- We do not disclose nonpublic personal information to nonaffiliated third parties.
- We disclose information when required by law or regulation.
- There are many state and federal laws that require us to disclose information to various government entities. Some examples of these laws are the Bank Secrecy Act, the Internal Revenue Code, and the Right to Financial Privacy Act. There are many other laws and regulations that require us, and our contractors and service providers, to disclose information. In addition, if our customer is involved in a legal proceeding, state and federal laws provide the parties to the litigation with the right to obtain records and information from us. In all these instances, we will disclose the information whenever required to do so by law, regulation, lawful judicial or administrative process, or court order.
- To the extent permitted by law, we may alter or amend these principles and any of the policies or procedures described above at any time without prior notice. The principles set forth above are for general guidance; they do not constitute a contract or do not modify or amend any agreements we have with our customers.
